1. General Provisions
These Terms and Conditions govern the sale of products, including but not limited to books, photographic prints, and official merchandise, via the website www.erikmessori.com. By placing an order, the Customer hereby agrees to be bound by these terms in their entirety.
2. Intellectual Property Rights
All content featured on the Website—including photographs, text, graphics, and logos—is the exclusive property of Erik Messori and is protected by international copyright and intellectual property laws. The purchase of a physical item does not constitute a transfer of any intellectual property rights. Any unauthorised reproduction, distribution, or commercial exploitation of the images is strictly prohibited.
3. Shipping, Fulfilment, and Delivery
Fulfilment: Orders are typically processed and dispatched within [7–10] working days. For bespoke prints or signed editions, lead times may be extended.
Delivery: We utilise reputable courier services. While we endeavour to meet estimated delivery dates, Erik Messori shall not be held liable for delays caused by postal services or customs clearance procedures.
4. Customs, Import Duties, and Local Taxes In accordance with international trade standards
Importer of Record: For all orders shipped to destinations outside the European Union, the Customer acts as the ‘Importer of Record’ and is solely responsible for the payment of any import duties, customs fees, and local taxes.
Payment: These additional charges are not included in the purchase price or shipping fees and must be settled by the Customer directly with the relevant local authorities or the courier upon delivery.
5. Returns and Cancellation Policy
Right of Withdrawal: Customers have the right to cancel their order within 14 days of receipt.
Conditions: To qualify for a refund, the product must be returned in its original, pristine condition, unused, and in its original packaging (including any intact protective seals).
Exclusions: Personalised items, books signed upon specific request, or digital assets are exempt from the right of return.
Return Logistics: Costs associated with the return of goods are to be borne by the Customer, unless the item is proven to be defective upon arrival.
6. Limitation of Liability
Erik Messori shall not be liable for any damage arising from improper handling, inadequate storage, or exposure to adverse environmental conditions (e.g., direct sunlight or humidity) once the goods have been delivered in satisfactory condition.
7. Governing Law and JurisdictionÂ
These Terms and Conditions shall be governed by and construed in accordance with Italian Law. Any dispute, controversy, or claim arising out of or relating to these terms shall be subject to the exclusive jurisdiction of the Italian Courts.
